These Terms & Conditions (“Terms”) apply to all guided hunts, services, reservations, and related activities provided by Silent Wings Hunt Club (“Silent Wings,” “Company,” “we,” “us,” or “our”). By booking a hunt, submitting payment, or participating in any activity with Silent Wings Hunt Club, you acknowledge and agree to these Terms.
 

1. RESERVATIONS & BOOKING

All guided hunts are subject to availability. Requested dates are not guaranteed until your reservation has been confirmed by Silent Wings Hunt Club and any required deposit has been received. If your preferred dates are unavailable, we will make reasonable efforts to offer the closest available dates. The individual making a reservation on behalf of a group is responsible for communicating these Terms and all applicable hunt requirements to every member of the group.
 

2. DEPOSITS & PAYMENT

A deposit of is required to secure your hunt dates.

The remaining balance must be paid no later than the last day(s) of the hunt. Reservations are not considered confirmed until the required deposit has been received. Unless otherwise agreed to in writing, hunters are responsible for expenses not expressly included in their hunt package, including licenses, stamps, transportation, lodging, meals, ammunition, gratuities, and other personal expenses.
 

3. CANCELLATIONS & REFUNDS

Deposits are non-refundable. Cancellations made within 14 days of the scheduled hunt are subject to policy. If a hunter cannot attend, Silent Wings Hunt Club may, at its discretion, allow the reservation to be transferred to another eligible hunter or rescheduled to another available date. No refunds will be provided for late arrivals, early departures, unused hunt days, personal scheduling conflicts, failure to obtain required licenses or stamps, or removal from a hunt due to unsafe or unlawful conduct.
 

4. WEATHER & HUNTING CONDITIONS

Waterfowl hunting is inherently dependent on weather, migration patterns, bird movement, habitat conditions, and other circumstances beyond our control. Silent Wings Hunt Club does not guarantee the number of birds seen, shots taken, birds harvested, or any other particular hunting result.Poor hunting conditions alone do not constitute grounds for a refund.

If weather, unsafe conditions, government action, property access issues, or another circumstance outside our reasonable control makes a hunt unsafe or impractical, Silent Wings Hunt Club reserves the right to delay, relocate, reschedule, modify, or cancel the hunt.
 

5. LICENSES, STAMPS & LEGAL REQUIREMENTS

Each hunter is solely responsible for obtaining and maintaining all licenses, permits, stamps, certifications, and other documentation required to legally hunt in Iowa and under applicable federal law.

Depending on the hunter and hunt, these requirements may include an Iowa hunting license, applicable Iowa migratory game bird requirements, Federal Migratory Bird Hunting and Conservation Stamp (“Federal Duck Stamp”), hunter education certification, and other required licenses, permits, fees, or registrations. Hunters should obtain all required documentation before arriving for their hunt. If assistance is needed, contact Silent Wings Hunt Club before your scheduled hunt. Hunters who need to obtain required documentation locally should plan to arrive early enough to complete the process before the hunt begins.

Failure to obtain legally required documentation may prevent participation and does not entitle the hunter to a refund.
 

6. COMPLIANCE WITH HUNTING LAWS

All hunters must comply with applicable federal, state, and local hunting laws and regulations, including regulations governing seasons, hunting hours, legal methods of take, ammunition, daily bag limits, possession limits, licensing, and protected species.

Each hunter remains personally responsible for identifying their target and ensuring that every shot and harvested bird complies with applicable law. Instructions from a Silent Wings Hunt Club guide do not relieve a hunter of their individual legal responsibilities.

Any hunter who intentionally or repeatedly violates hunting laws may be removed from the hunt without refund.
 

7. FIREARMS & HUNTER SAFETY

Firearms must be handled safely at all times.

Hunters are expected to follow all instructions provided by Silent Wings Hunt Club guides regarding firearm handling, shooting zones, loading and unloading, positioning, movement, and general field safety. Silent Wings Hunt Club and its guides reserve the right to immediately stop a hunt or remove any individual whose conduct is considered unsafe. Unsafe conduct includes, but is not limited to, unsafe firearm handling, shooting outside designated shooting zones, handling a firearm while impaired, disregarding guide instructions, reckless behavior, or knowingly violating hunting regulations. Removal for unsafe or unlawful conduct will not result in a refund.
 

8. ALCOHOL & CONTROLLED SUBSTANCES

Hunters may not participate in a hunt while impaired by alcohol, illegal drugs, or any substance that materially compromises their ability to safely handle a firearm or participate in hunting activities. Silent Wings Hunt Club and its guides have sole discretion to determine whether a hunter may safely participate. Any hunter considered impaired may be prohibited from participating or removed from the hunt without refund.
 

9. GUIDE AUTHORITY

For the safety of the group, Silent Wings Hunt Club guides have final authority regarding field operations during a guided hunt.

Hunters must follow guide instructions concerning hunting locations, shooting zones, firearm safety, weather conditions, transportation, dogs, equipment, and other operational or safety matters. A guide may delay, modify, relocate, or terminate a hunt when the guide reasonably believes conditions are unsafe, unlawful, or unsuitable for continuing.
 

10. ASSUMPTION OF RISK

Hunting and outdoor activities involve inherent risks that cannot be completely eliminated.

These risks may include firearms, ammunition, wildlife, hunting dogs, boats, vehicles, uneven or unstable terrain, mud, ice, snow, water, agricultural land, fences, equipment, weather, extreme temperatures, falls, drowning, collisions, and the actions of other participants. By participating, hunters acknowledge that these activities involve risks of property damage, illness, bodily injury, permanent disability, and death. Each participant voluntarily chooses to participate with knowledge of these inherent risks.

Participation may also require execution of a separate Assumption of Risk, Release of Liability, and Indemnification Agreement before entering the field.
 

11. PERSONAL PROPERTY

Hunters are responsible for their firearms, ammunition, clothing, electronics, vehicles, equipment, and other personal property.

To the fullest extent permitted by applicable law, Silent Wings Hunt Club is not responsible for personal property that is lost, stolen, damaged, submerged, misplaced, or otherwise affected during a hunt or related activity.
 

12. TRANSPORTATION

When transportation is provided as part of a hunt, hunters agree to follow all safety instructions provided by Silent Wings Hunt Club or its guides. Hunters who operate their own vehicles remain responsible for their vehicle, passengers, insurance, and compliance with applicable laws. Hunters may encounter gravel roads, fields, mud, snow, ice, standing water, and other conditions capable of damaging or immobilizing vehicles.
 

13. DOGS

Silent Wings Hunt Club may use trained hunting dogs during guided hunts.

Hunters agree to follow all guide instructions concerning interactions with and shooting around dogs.

Hunters may not bring personal hunting dogs unless approved by Silent Wings Hunt Club in advance.
 

14. PROPERTY & LANDOWNER RULES

Guided hunts may occur on privately owned, leased, managed, or otherwise authorized hunting property.

Hunters must respect all property, crops, livestock, equipment, gates, structures, and landowner requirements.

Hunters may not return to, access, scout, hunt, photograph for commercial purposes, or otherwise use private hunting locations outside their scheduled hunt without express permission from Silent Wings Hunt Club and/or the landowner.

The location of private hunting areas should be treated as confidential unless otherwise authorized.
 

15. DAMAGES

Hunters may be held financially responsible for damage caused by their intentional, reckless, or negligent conduct to Silent Wings Hunt Club property, landowner property, vehicles, blinds, decoys, equipment, lodging, or other property used during the hunt.
 

16. MINORS

Hunters under 18 years of age must be accompanied by a parent, legal guardian, or other authorized adult when required by law or Silent Wings Hunt Club policy. Parents and guardians are responsible for ensuring that minors satisfy all applicable licensing, hunter education, supervision, and safety requirements. Silent Wings Hunt Club may require a parent or legal guardian to execute additional participation and liability documents on behalf of a minor.
 

17. PHOTOGRAPHY & MEDIA

Silent Wings Hunt Club may photograph or record portions of guided hunts for promotional, educational, website, advertising, or social media purposes. By participating, hunters authorize Silent Wings Hunt Club to use their image and likeness for these purposes without additional compensation.
 

18. NO GUARANTEE OF HARVEST

Silent Wings Hunt Club provides guiding services, hunting access where applicable, field preparation, equipment, knowledge, and related services. Wild animals cannot be controlled or guaranteed. Accordingly, Silent Wings Hunt Club makes no guarantee regarding bird numbers, opportunities, shooting success, limits, harvest totals, or any particular hunting experience or outcome.
 

19. RELEASE & LIMITATION OF LIABILITY

To the fullest extent permitted by applicable Iowa law, participants acknowledge and assume the inherent risks associated with hunting and outdoor activities. Additional releases, waivers, indemnification obligations, and limitations of liability may be contained in Silent Wings Hunt Club's separate participant waiver, which must be completed when required before participation.

Nothing in these Terms is intended to waive or limit any right or liability that cannot legally be waived or limited under applicable law.
 

20. FORCE MAJEURE

Silent Wings Hunt Club will not be responsible for failure or delay in providing services caused by circumstances reasonably outside its control, including severe weather, flooding, natural disasters, wildfire, disease outbreaks, government orders, road closures, property access restrictions, equipment failures, or changes in hunting laws or regulations. When reasonably possible, Silent Wings Hunt Club will attempt to reschedule affected hunts or provide another appropriate solution according to its booking policies.
 

21. CHANGES TO HUNT LOCATIONS OR ITINERARY

Waterfowl movement and hunting conditions can change quickly. Silent Wings Hunt Club reserves the right to change hunting locations, meeting locations, start times, field assignments, guide assignments, and other logistical details when reasonably necessary to provide the hunt or respond to weather, bird movement, land access, safety concerns, or other conditions.
 

22. GOVERNING LAW

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles.

To the extent permitted by law, any dispute arising from these Terms or services provided by Silent Wings Hunt Club shall be brought in the appropriate state or federal court located in Story County, Iowa.
 

23. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
 

24. CHANGES TO THESE TERMS

Silent Wings Hunt Club may update these Terms periodically. The Terms applicable to a reservation will be those presented or otherwise incorporated into the booking process at the time the reservation is confirmed, unless changes are required by law.
